General terms and conditions online sales

These terms of sale are concluded on the one hand by the company J2MN with a capital of 10,000 euro, with its registered office in Paris (75) registered in the Register of commerce and companies of Paris under number 814 428 462 00018, hereinafter referred to Pied de Biche Paris, and on the other hand, by any natural or legal person wishing to make a purchase on the Pied de Biche internet site, hereinafter referred to as the buyer.

Article 1. Object

The present terms and conditions of sale are intended to define the contractual relations between Pied de Biche-Paris and the buyer and the conditions applicable to any purchase made through the Pied de Biche-Paris merchant site, whether the purchaser is an end consumer or a trade.. The acquisition of a property or service through this site implies an unreserved acceptance by the buyer of these terms and conditions of sale.
These conditions of sale will prevail over any other general or particular condition not expressly approved by Pied de Biche-Paris.
Pied de Biche-Paris reserves the right to be able to change its conditions of sale at any time. In this case, the terms and conditions shall be those applicable at the date in effect the order was placed. 

Article 2. Characteristics of the goods and services proposed

The Products available for sale are those which appear on the Pied de Biche Site on the day the site is viewed by the customer. 
These products and services are offered within the limit of available stock.
Each product is accompanied by a description prepared by the supplier; For some products, the buyer can have access to the supplier's documentation.
The upmost care is exercised in presenting the products on the Site and they are as true as possible to the product, nevertheless the photographs which illustrate the Products are merely indicative but cannot ensure a perfect similarity with the product offered, especially with regard to their colour. 

Article 3. Prices

The prices listed in the catalogue are priced in Euro and inclusive of all taxes. These prices include the VAT applicable on the day the order was made; Any change in the rate may be passed on to the price of the goods or services.
Pied de Biche reserves the right to modify its prices at any time, but it is understood that the price listed in the catalogue on the day of the order will be the only one applicable to the buyer.
The prices listed include the cost of processing the order but do not include shipping and delivery costs.

Article 4. Geographic cover

Pied de Biche-Paris delivers its products all over the world. The policy for delivery and returns is detailed in the said section. Shipping costs include participation in the preparation and packaging costs, as well as postage costs. The amount of these fees is indicated in the "basket" section and is subject to the buyer's approval before each order is validated. For shipments outside Europe, all potential customs charges remain at the expense of the buyer.

Article 5. Orders

The buyer, who wishes to purchase a product or a service must:
– Complete the registration form where he will provide all the contact information requested;
– Validate the order after checking it;
– Make the payment as specified;
– Confirm the order and payment.
The confirmation of the order entails acceptance of these conditions of sale, acknowledgment of its contents and  the renunciation to own terms conditions of purchase or other conditions.
All the data provided and the recorded confirmation will be considered a record of the transaction. The confirmation will be as binding as a signature and represent an acceptance of the transaction.
The seller will communicate by e-mail the confirmation of the order.

Article 6. Right of withdrawal

As a consumer, you may cancel your contract in relation to Products purchased on the Website, without any penalty, with the exception of any returns costs. You have until January 15th to submit your returns request for an exchange or refund. When free return available, each order allows only one free return. 

When you have requested a refund, we will credit the amount you paid by credit card or Paypal for the item returned on the original account that was used to pay for your order. This can be a bank account or Paypal account.

In case of return of all or part of the order paid in full or in part with an illicado card, the refund will be made to the same gift card, which will be automatically credited with the amount of the returned item, within the limit of the amount initially paid by this same payment method. It is requested that the customer keeps the illicado card (physical card or dematerialised card) for the duration of the possible return. In the event that the validity period of the gift card in question has expired at the time of the refund, the refund will be made in the form of a credit note/voucher at Pied de Biche.

In the event that all or part of an order paid for with a Pied de Biche gift card is returned, the refund will be made to the same gift card, which will automatically be re-credited with the amount of the returned item, within the limit of the amount initially paid by this same payment method. The card will then be reactivated. In the event that the validity period of the gift card concerned has expired at the time of the refund, the refund will be made in the form of a new voucher, the duration of which will be 3 months (not renewable).

Article 7. Terms of payment

The price is due when the order is made. Payment will be made by credit card and through the secure system protocol SSL (Secure Socket Layer) Hipay which uses the secure Socket Layer (SSL) so that the transmitted information is encrypted by a software and cannot be read during transfer.
The buyer's account will be debited after the order has been validated.
An invoice showing the applicable VAT is available at any time in the buyer's account, or upon simple request.

Article 8. Deliveries

Deliveries are made to the address indicated in the order, which can only be within the specified geographical area.
The buyer is liable for any risk as soon as the product has left the Pied de Biche premises. In case of damage occurring during transportation, the complaint must be made to the carrier within three days of delivery.
Delivery times provided are only indicative but if these exceed thirty days from order, the contract of sale may be terminated and the buyer offered a full refund. Returns or exchanges policy: You have 30 days after receiving the parcel to return your items for any reason or if the size is not right. The products must be returned to us in their original condition and box. A pair with temporary pads can not be considered as in its original condition. You can exchange them with a similar item or receive a full refund. In the event of a request for a partial refund of an order which had benefited from a stepped reduction to the total basket, the amount refunded will be calculated by taking into account the discount percentage of the retained item(s). The buyer shall bear the costs for returns and the refund will be credited no later than 21 days after receipt of the returns parcel on the original payment card or Paypal account used at the time of purchase. In case of a refund request, please make sure that the payment method used for the order is still valid. If it isn’t  please send your new bank details to contact@pieddebiche-paris.com.
An order payed with credit can not lead to a refund.

Article 9. Warranty

All products supplied by the seller benefit from the statutory warranty provided for in articles 1641 and following of the French Civil Code.
In case of non-compliance of a product sold, it can be returned to the seller who can take it back, exchange or refund it. 
All claims, exchanges or refund requests, must be made within thirty days of the delivery date.
All our products are quality tested. You also have one year after receiving the parcel to write to us if there is a manufacturing defect. The warranty does not take cover any damage caused by negligence or misuse by the customer. Only Pied de Biche will have authority to determine whether the product is covered by the warranty or not.

Article 10. Responsibility

The seller is only bound to an obligation of means; His liability may not be incurred for damage resulting from the use of the Internet such as data loss, intrusion, virus, service disruption, or other involuntary problems.

Article 11. Intellectual Property

All content on the Pied de Biche website is and remains the exclusive and intellectual property of Pied de Biche-Paris.
No one is allowed to reproduce, capitalise on, disseminate or use in any way, even partially, these intellectual property rights whether they are hardware, software, visual or sound elements.

Article 12. Personal data

In accordance with the Act on Information Technology and Civil liberties of 6 January 1978, the information of a personal nature relating to buyers may be subject to automated processing.
Pied de Biche-Paris reserves the right to collect information about buyers, including using cookies, and, if they so wish, to transfer to commercial partners the information collected.
Buyers may object to the disclosure of their contact information upon request to Pied de Biche-Paris. Likewise, in accordance to Act on Information Technology and Civil Liberties of 6 January 1978, users have the right to access and rectify the data concerning them,
Pursuant to this Act, the processing of personal data collected on the Site, including the management of user e mail addresses has been reported to the National Commission for Information Technology and Civil Liberties (CNIL) on 10 November 2015, recorded under filing 1903848V0.

Article 13. Archiving-Proof

Pied de Biche-Paris will archive invoices on a reliable and durable platform for the purpose of constituting a faithful copy in accordance with the provisions of article 1348 of the French Civil Code.
Pied de Biche - Paris electronic records will be considered by the parties as evidence of communications, orders, payments and transactions between the parties.

Article 14. Dispute resolution

The present general terms of sale and the contractual relations between the parties are governed by French law.
In case of litigation, jurisdiction will be assigned to the competent courts notwithstanding plurality of defendants or warranty appeals.
